St. Louis Litigation attorneys Tim Gearin, Dave Ott and Nick Cejas secured a defense verdict for client SSM Health Care March 27 in a contentious wrongful death lawsuit filed in 2010. The plaintiffs sued following the death of a 78-year-old man who fell while walking into an SSM procedure facility in September 2009. He struck his head in the fall and later died of his injuries. The plaintiffs alleged that one of the concrete slabs in the walkway leading to the entrance was uneven and caused him to fall, and asked the jury to award them $7.2 million. Following a six-day trial in St. Louis County Circuit Court, the jury found in favor of SSM.
