As a member of the Litigation department, Darren K. Sharp’s practice is diverse with substantial experience in the areas of business and franchise litigation and arbitration. As lead counsel in jury trials in Kansas and Missouri, he defends clients in lawsuits involving business torts, franchise and distribution disagreements, vacating/confirming arbitration awards and employment discrimination claims.

Business Litigation. For medium-sized to large corporations, Darren litigates national and international disputes that challenge a company’s ongoing operations and financial security. Matters he handles encompass claims of employment discrimination involving allegations of race, age, national origin and disabilities; distributorship agreements; general breach of contract cases; and business torts such as fraud, misrepresentation, conversion, and interference with contract; unfair and deceptive trade practices; and intellectual property claims, including trademark infringement and dilution claims.

Franchise and Distribution Litigation. Throughout the country, Darren guides franchisors and manufacturers with distribution systems through the full range of issues relating to franchising and distribution. He litigates and counsels regarding breaches of franchise and distribution agreements; franchise terminations, transfers, and renewals; violations of franchise disclosure, relationship, and business opportunity laws; unfair competition claims; trademark, trade dress and trade secret claims and violation of non-compete and non-solicitation covenants.

Arbitration. In state and federal courts and before panels and single arbitrators, Darren advocates for clients in commercial disputes and business-related torts.

Appellate Advocacy. Darren has drafted many winning appeal briefs and successfully argued multiple appeals before state and federal courts of appeal involving arbitration agreements and awards, franchise disputes and business torts.

Darren’s experience extends to insurance defense work. He is also knowledgeable in land use law, especially involving eminent domain, constitutional issues, zoning, planning commissions and obtaining land use approvals.
