David Kornelis primarily handles commercial transactions and business litigation, with special emphasis on the commercial and industrial construction industry. In his construction practice, he has represented diverse clients with a broad range of interests: contractors, subcontractors, material and equipment suppliers, project owners, architects and engineers, lenders, and bond sureties. He also represents a variety of clients in the manufacturing and service industries.
For clients on both private and government construction projects, David’s work has included reviewing, negotiating, and drafting contracts between owners and design professionals and between owners and contractors, design-build and construction management agreements, joint venture agreements, subcontracts, and purchase orders for material and equipment. He has prepared form contracts and purchase orders designed for repeated use, as well as customized agreements for specific projects.
In addition to his contract work, David has counseled clients on issues and disputes arising during and after contract performance, and has provided representation in both informal dispute resolution efforts and mediation, arbitration, and litigation. He has prepared and prosecuted, and defended, claims for defective work or failure to perform work; payment claims for work beyond contract scope; construction delay, disruption, and acceleration claims; and mechanic’s lien and bond claims. He has represented clients in litigation before state and federal courts in Missouri, Kansas, California, Colorado, Louisiana, Michigan, Nevada, Texas, and Wyoming and the U.S. Court of Federal Claims.
