The Appellate Court of Illinois, Fifth District has ruled in favor of an Armstrong Teasdale client who was sued by neighbors who alleged the client was responsible for the flooding of their property. The appeals court on March 11, 2010 reversed a ruling by the Circuit Court of St. Clair County that held Hildegard Hollenbeck liable. The panel found there was no evidence to show that the flooding was caused by construction on Hollenbeck’s land, which is located downstream from the plaintiffs’ property.
