An experienced litigator and trial lawyer, Nick Clifford serves individuals and private and public companies in a wide variety of industries in cases involving diverse technologies and subject matters. As co-leader of the Intellectual Property Litigation practice group, much of his practice focuses on counseling clients in matters involving intellectual property disputes.
Mindful that intellectual property is the true core of a business’s assets, Nick provides strategic, value-driven advice on prosecuting and defending litigation. In state, federal, and appellate courts across the country, he litigates patent, copyright, and trademark infringement matters, as well as trade secret misappropriation. Nick’s experience with these disputes has involved a broad range of technologies including business methods, plastic injection molding, computer memory devices, luggage, dehumidifiers, retinal surgical devices, load transfer devices for concrete floors, automotive differentials, electronic voting machines, emergency vehicle lightbars, cable video-on-demand, LED warning signal lights, baby monitors, interactive financial trading platforms, stock alerting services, automotive service products (wheel alignment and balancing; machine vision), bingo handsets, cassette tape deck player assemblies, fly fishing reels, computer maintenance diagnostic software, and educational software.
Nick counsels clients on patent infringement issues, false patent marking claims, preparation of non-infringement and invalidity opinions, patentability, and other due diligence issues. Within the copyright and trademark arenas, he assists clients with advice on registration, licensing, and litigation.
The balance of Nick's work extends to general commercial litigation, including UCC matters, fraud cases, insurance coverage actions, and contract disputes.
