A member of the Corporate Services practice group, Rico Kolster focuses in the construction area counseling on residential, commercial and industrial projects with special emphasis on power generation, infrastructure and renewable fuels projects. He is fluent in Spanish.

Serving lenders, owners, contractors, subcontractors, design professionals, industrial equipment manufacturers and technology innovators, Rico provides complete “cradle to grave” legal services on construction projects. His counsel often pertains to project financing, prime contract development and negotiations, downstream construction contracting, claims avoidance/preparations, risk mitigation and many ancillary issues related to domestic and international construction projects.

Through various dispute resolution actions, Rico has mediated, arbitrated and/or litigated disputes arising from contractual breach, construction defects, delay and extended construction, mechanic’s liens and foreclosure actions on construction projects and labor disputes.

The balance of Rico’s practice revolves around merging the increasingly important field of energy sustainability and climate change with pertinent regulations in the construction industry. Locally, nationally and internationally, he handles a broad array of industrial projects. These projects generally include future energy initiatives such as co-generation power plants, ethanol production facilities, simple and combined cycle power plants, nuclear power plants, coal plants, hydro power generation stations and diesel power generation facilities.

For numerous energy contracts and for major architectural and engineering firms, Rico develops and negotiates prime and downstream contracts involving power generation and renewable fuel in various formats. These formats include EPC, EPT, GC, EPCm, trade, services, architectural and owner’s engineer contracts in all available structures.

Background

Prior to his legal career, Rico was (and remains) a licensed professional engineer with over 13 years of experience working for major international engineering firms, including Bechtel and Black & Veatch. He then served as in-house counsel for a major Architect/Engineering (AE) firm working on all aspects of industrial construction including the purchase of major engineered equipment, materials and services for on-going construction projects. After working for industry, Rico practiced at a major international firm where he was a lead construction and energy partner.
