Bianca Valcarce is a member of the firm’s Litigation practice group, where she counsels clients on a variety of civil, criminal and regulatory matters with a focus on government investigations and white-collar criminal defense; environmental liability and enforcement; complex commercial litigation; and internal investigations and regulatory compliance. Bianca has experience representing large corporations, senior-level executives, individual business owners, government contractors and health care providers across the pharmaceutical, medical device, health care, manufacturing, construction, transportation and financial services industries.

In her white-collar practice, Bianca regularly represents clients facing regulatory inquiries, civil complaints and criminal prosecution at federal and state levels. She has experience guiding clients in reacting and responding to subpoenas, search warrants and information requests from various law enforcement and regulatory agencies, including the Department of Justice (DOJ), Department of Health and Human Services (DHHS), state Attorneys General across the country, and various federal and local environmental protection agencies. Bianca also has experience conducting internal investigations and assisting organizations of all sizes in developing compliance strategies and managing risk.

Bianca has extensive knowledge of and experience with the False Claims Act (FCA), including the defense of qui tam actions, and Anti-Kickback Statute (AKS) allegations, as well as a broad array of experience related to allegations of health care fraud, financial and business frauds, securities violations, environmental crimes, racketeering, antitrust violations, discrimination and harassment, mail and wire fraud, and conspiracy.

Bianca has particular experience with the unique and ever-changing legal and regulatory scheme impacting the health care, pharmaceutical, and medical device industries. This experience includes matters involving Medicare/Medicaid billing fraud; physician referrals; HIPAA and confidential health information; off-label marketing and promotion; patient assistance programs; co-pay foundations; physician speaker programs; generic drug pricing; FDA compliance issues; and other allegations of fraud, waste and abuse.

Environmental law also comprises a significant portion of Bianca’s practice, wherein she regularly advises clients facing government investigation, regulatory enforcement and private litigation, including so-called “Citizen Suits,” often instituted by environmental advocacy organizations. Bianca frequently defends manufacturers, former facility owner/operators, transportation companies, construction companies and real-estate holders with respect to alleged environmental violations, as well as plaintiff-individuals experiencing negative environmental impacts. Bianca has provided sound counsel in matters concerning the Clean Air Act (CAA) and Clean Water Act (CWA), CERCLA, FIFRA and other federal and state environmental statutes, as well as administrative appeals and related common law tort claims. These engagements have concerned issues including oil spills, per- and polyfluoroalkyl substances (PFAS), hazardous substances, anti-microbial coatings, and other regulated effluent and emissions.

Bianca also guides clients in navigating a variety of complex commercial and business litigation matters, including class action litigation, multi-district litigation and parallel proceedings. Bianca has also represented municipalities and served as conflicts counsel for state government agencies.
