Representative Matters

  • Serve as outside general counsel to international engineering firm specializing in the mining industry
  • Serve as outside counsel for the South Central Joint Mine Health and Safety Conference Association (SCJMHSC)
  • Counsel to consulting firm serving large mining companies
  • Serve as a member of the Board of Directors of the Missouri Mine Safety and Health Conference, a 501(c)(3) organization
  • Provide MSHA-related training to mine operators and mine supervisors regarding compliance issues and supervisor rights and responsibilities
  • Conduct accident and injury investigations for mine operators
  • Currently defending multiple mine operators in all facets of litigation involving enforcement actions issued by MSHA, including, but not limited to, significant and substantial (S&S) violations; 104(d) unwarrantable failures; 105 discrimination actions; 107(a) imminent dangers and Section 110 investigations
  • Currently representing an international coal company regarding traditional labor matters and union avoidance
  • Currently advising a coal company in its initial public offering
  • Active in submitting comments to proposed rulemaking by MSHA

  • Represented a diversified producer of lime and calcium-based products in: commercial lawsuits, property tax appeals and MSHA matters, including assisting with accident investigations (some involving several mine fatalities) and an investigation of diesel emission in underground mines; appeals of penalty actions, environmental work including Clean Air Act issues and permit appeals
  • Negotiated professional services agreement between an engineering firm and coal companies
  • Represented a coal company in litigation and general corporate matters
  • Managed internal corporate reorganization for a major coal company and advised on subsidiary management
