Denver Litigator Wins Dismissal of Suit against Major Telecommunications Company

In a victory for our client, a major telecommunications company, a Colorado federal judge has dismissed a breach of contract suit against the company, which had been sued for terminating a real estate lease. The company was represented by partner Chuck Steese and associate John Osgood, both of the Denver office. Their motion to dismiss was granted on September 10, 2015, by U.S. District Judge Philip Brimmer. 

The suit had been filed by the owner of the property located in Clear Creek County, Colorado. The owner alleged that our client wrongfully terminated the lease. However, our team successfully argued that our client had the right to end the contract under a provision allowing for termination if the site was no longer appropriate for the lessee's operations due to technological reasons. Our client will now seek recovery of its attorneys' fees and costs as authorized under the lease.
