Armstrong Teasdale Litigators Win Missouri’s Second-Largest Defense Verdict

Armstrong Teasdale litigators Timothy J. Gearin, David G. Ott, and Maureen O. Bryan have won Missouri’s second-largest 2013 defense verdict by defeating a neurosurgeon’s lawsuit that blamed St. Luke’s Hospital for a fall that ended the doctor’s career. Missouri Lawyers Weekly, which ranks the cases, valued the verdict at $13 million. This marks the second time the publication has honored the Armstrong Teasdale litigators for their work on this case. It is also the fourth top defense ranking for the group since 2002.

The suit was filed by Dr. Alexander Marchosky, who slipped on a clear cleansing solution in 2007 and permanently injured his shoulder. He first sued the hospital for negligence in 2008, claiming the spill was not cleaned up and he was not warned properly. A jury found in favor of St. Luke’s in 2010 and the Armstrong Teasdale team won Missouri Lawyers Weekly’s top defense verdict award for that year. However, the surgeon won a new trial on appeal. In April 2013, the second jury also sided with St. Luke’s after finding the hospital was not at fault.

Gearin is leader of the firm’s Health Care group within the Litigation practice. He received his J.D. from Saint Louis University School of Law and B.S.N., cum laude, from the University of Missouri - St. Louis.

Ott is a member of the firm’s Tort & Catastrophic Events group within the Litigation practice. He received his L.L.M. from Washington University School of Law, summa cum laude; J.D., summa cum laude, from the University of Missouri School of Law; and B.S., summa cum laude, from Quincy College.

Bryan is also a member of the firm’s Tort & Catastrophic Events group. She received her J.D., magna cum laude, from Washburn University School of Law and B.A. from the University of Arizona.
