Monte Mann Provides National Media with Analysis of Albertsons, Kroger Litigation
Armstrong Teasdale Partner Monte Mann has been quoted in several national media outlets regarding the lawsuit between grocery chains Albertsons and Kroger over their unsuccessful effort to merge. Albertsons is seeking $8 billion in damages including $600 million breakup fee and compensation for shareholder losses from Kroger’s alleged failure to engage in good-faith efforts.
Speaking with Bloomberg News, Mann said an important aspect of the trial will be what Kroger executives were saying internally “because that’s going to tell the judge a great deal about whether this was a failed strategy or it was a knowing breach of bad faith.”
In addition, in an extensive interview with TheStreet, Mann explained “Kroger didn’t necessarily have to succeed in getting regulatory approval. But it did have to live up to whatever commitments it made in the merger agreement. That’s where I’d expect much of the fight to be.” Mann’s commentary on the trial also appeared at Yahoo Finance, Business Mirror, and Transport Topics.
The trial began Oct. 19 in Delaware Chancery Court and is expected to last two weeks.
A Chicago business trial lawyer with three decades of experience in complex commercial disputes, Monte Mann is frequently called upon by national and international media to analyze significant business litigation and its implications for companies and their leaders. He has provided commentary to outlets including the Associated Press, BBC, Fox Business, The Guardian, Bloomberg Law, Law360, The American Lawyer, The National Law Journal, Corporate Counsel and Law.com.
