A member of the Litigation practice group, Chad Silker handles tort, commercial, and real estate litigation matters. From individuals to small businesses to Fortune 500 companies, he manages cases involving transportation and trucking, insurance coverage, premises liability, property disputes, a wide range of product liability issues and high stakes tobacco cases.
Tort Defense. Chad counsels on a wide variety of tort matters. He represents domestic and foreign manufacturers, distributors, and retailers in disputes concerning a wide range of products, including food materials, tobacco products, home appliances, and industrial, commercial, and recreational equipment. Chad goes above and beyond to learn the intricacies of a client’s product, then applies that knowledge to execute innovative techniques to achieve favorable results.
Additionally, Chad defends commercial trucking companies and drivers involved in auto accidents. A strong working knowledge of the federal regulations and relevant trucking laws enables him to provide guidance from the initial accident and preservation of evidence through trial.
Chad's tort experience also includes defending personal injury claims made against businesses and commercial property owners, such as slip and falls, property hazards and construction accidents.
Insurance Coverage. Chad analyzes complex property, casualty, and liability insurance coverage issues, and litigates coverage disputes involving vexatious refusal, wrongful denial, breach of contract, misrepresentation, non-payment and other policy-related issues.
Commercial Litigation. Chad provides guidance to businesses and individuals on a variety of commercial matters, including contract disputes between vendors and buyers, and landlord/tenant lease issues. His experience representing parties on both sides of the table permits him to seek efficient, effective results for his clients, whether or not a lawsuit has been filed.
Real Estate. For both individuals and major corporations, Chad counsels on property issues, including condemnation, quiet titles, easement disputes, and nuisance and trespass claims.
Involved in pro bono activities, Chad served two years as a Special Assistant Circuit Attorney for the City of St. Louis, prosecuting felony drug cases. He also represented an immigrant family facing deportation after the government refused to process immigration paperwork submitted before the sudden and unexpected death of the mother's US citizen husband, achieving a favorable summary judgment ruling in the Eastern District of Missouri that permitted the family to remain in the United States.
Background
During law school, Chad served as a research assistant to Professor James Seckinger, a leading figure in the instruction of trial advocacy and deposition skills, and worked at the Notre Dame Legal Aid Clinic, gaining experience in the areas of landlord/tenant and social security benefits law. He was also executive articles editor of Notre Dame's Journal of Legislation.
