A skilled trial lawyer and member of the firm’s Business Litigation, Non-Compete/Trade Secrets, and Future Energy practice groups, Scott Kozak focuses on toxic tort, complex commercial, environmental, construction, and securities litigation and arbitration. In addition to his litigation practice, he is an active member of the Future Energy Group steering committee, a multidisciplinary team helping clients achieve compliance, find solutions, and discover opportunities in the energy sector.
Toxic Tort. Scott is well-versed in the handling of toxic tort claims stemming from alleged environmental contamination and the various personal injury and commercial issues arising from such allegations. In these matters, he defends Fortune 150 and 500 companies against personal injury, contract and complicated commercial litigation.
Complex Commercial. In state and federal courts across the country, before the Court of Appeals, and in various arbitration forums, Scott litigates commercial and related civil matters. These cases include all manner of commercial disputes, including defense and/or trial of non-compete, insurance, personal injury, real estate, and complex contractual and commercial claims.
Environmental and Construction. Scott investigates and defends accusations of regulatory violations, including those for alleged violations of OSHA, CERCLA and other regulatory regimes.
Securities. Before FINRA arbitration panels, Scott represents both multinational brokerage firms and their registered investment advisors and some plaintiffs. Most often these disputes involve breach of fiduciary duty, unsuitability and negligence claims.
