Dismissal of Individual and Representative Labor Code Claims on Behalf of Food Services Company
Represented on-premises food service company in heavily litigated arbitration brought by former employee alleging claims for unreimbursed business expenses in connection with work from home program. Claimant also sought penalties in related state court proceeding under California’s Private Attorneys General Act of 2004 (PAGA). After obtaining key concessions at claimant’s deposition, obtained dismissal of all claims with prejudice in exchange for a waiver of fees and costs. Claimant also stipulated to dismissal of the related state court proceeding because he was not “aggrieved” within the meaning of Labor Code section 2699(c) and, therefore, lacked standing to act as a PAGA representative.
