Almost every company that is paid with federal funds has a disgruntled employee just waiting to become a whistleblower. Under the federal False Claims Act, a private person, known as a relator, can file qui tam actions on behalf of the government alleging frauds against the U.S. If relators prevail, they can share in any money recovered. This program will discuss the defense of FCA cases and the steps in-house counsel and companies can take to protect themselves against these types of allegations. Topics will include the background of the False Claims Act and qui tam procedure, including common defenses; recent case law update; False Claim Act retaliation provisions and related litigation; and internal policies and whistleblower handling procedures.
