This background includes state, federal and administrative trial and appellate work as well as arbitration and mediation.

The Litigation practice is divided into a number of focused subgroups. One of these groups is Employment and Labor, which represents both unionized and non-unionized corporations and institutions in all aspects of employment-related legal matters and litigation. This includes providing advice and representation to clients in all aspects of their rights and obligations under a wide spectrum of employment discrimination laws.

Another example is our Health Care Litigation subgroup, which represents hospital systems, physician practice groups, individual physicians, nurses and all other medical specialists within the health care industry. This practice is not limited to defending litigated cases; we actively work with clients and risk managers to identify, avoid and resolve risk.

We also have a dedicated Intellectual Property Litigation group consisting of trial attorneys with a proven track record in this unique area that combines evolving scientific technologies with law. Using a team approach, our trial attorneys join forces with our patent lawyers and other intellectual property professionals, who have degrees in chemistry and biochemistry, biological sciences, electrical and mechanical engineering, information systems and other technical fields.

In addition to the traditional areas of litigation, the firm has nationally recognized niche practices in Security and Facility Clearance Services, and Fire and Electrical Liability.

Representative Matters

Won a 2015 Missouri Supreme Court ruling that our client, a major utility, was immune from a wrongful death suit under the Missouri Recreational Land Use Act.

Cave Consulting Group, Inc. v. OptumInsight, Inc. (Northern District of California). Obtained jury verdict of patent infringement and awarded $12 million in past damages. Additionally, obtained complete defense verdict on defendant’s counterclaim for infringement of eight patents.

Obtained summary judgment on behalf of Anesthesia Associates of Kansas City in a qui tam False Claims Act (FCA) case seeking more than $1 billion on behalf of the United States. June 9, 2015 by U.S. United States District Court, Western District of Missouri.

Abbott v. Missouri Gas Energy. Won the largest 2014 defense verdict in Missouri on behalf of Missouri Gas Energy in a $30 million furnace explosion case. The ranking was reported by Missouri Lawyers Weekly.

Won the second-largest 2013 defense verdict in Missouri for its representation of St. Luke’s Hospital in a medical negligence case. The ranking was reported by Missouri Lawyers Weekly.

Frito-Lay North America Inc. v. Medallion Foods Inc. and Ralcorp Holdings Inc. (U.S. District Court for the Eastern District of Texas, Sherman Division). Successfully defended clients against allegations of patent and trademark infringement and trade secret misappropriation in litigation over bowl-shaped tortilla chips.

Morpho Detection, Inc. v. Smiths Detection, Inc. (Eastern District of Virginia). Obtained jury verdict of patent infringement in case involving equipment used at airports to screen luggage and individuals.
