Armstrong Teasdale Prevails on Motion for Summary Judgment and Defeats Every Claim Brought Against Its Industry-Leading Client

Chicago Armstrong Teasdale Partners Monte L. Mann and Yvette V. Mishev recently prevailed on a motion for summary judgment on behalf of one of the largest independent providers of maintenance support and financial services in business aviation. 

The plaintiff, a private air charter company, brought claims for breach of contract, unjust enrichment, promissory estoppel and fraud arising from a complex engine maintenance contract. The plaintiff sought several million dollars in compensatory damages, punitive damages and attorney fees pursuant to the contract’s prevailing party provision. 

After three years of litigation, the parties filed cross motions for summary judgment. Mann and Mishev argued that none of the plaintiff’s claims were supported by the record or applicable law. The Circuit Court of Cook County agreed with Mann and Mishev and granted summary judgment in favor of our client on every claim asserted by plaintiff. The Court not only held that plaintiff’s claims against our client were not supported by the record, but also found that plaintiff is the one that breached the contract and that our client is entitled to payment for services rendered.

Mann and Mishev intend to seek attorney fees pursuant to and in accordance with the contract’s prevailing party provision.
