Secured Dismissal of $400K Claim for Banking Client
Successfully represented bank in St. Louis County Circuit Court against allegations of negligence and breach of fiduciary duty in the handling of trust funds, resulting in dismissal of all counts. The plaintiffs voluntarily withdrew their claims based on arguments prepared in our motion to dismiss addressing the plaintiffs’ failure to satisfy Missouri’s fact-pleading standard and demonstrate the existence of a duty owed by a third-party depository bank.
