Summary Judgment for Public Entity in Negligence Case
Obtained summary judgment in Missouri state court on behalf of a public entity on negligence claim relating to demolition work performed by the general contractor. The plaintiff was the owner of property that shared a party wall with a building owned by the public entity. The plaintiff alleged that even though an independent contractor performed the work, the public entity was liable for damage caused to its building during demolition. We demonstrated that a landowner is not vicariously liable for damage caused to third parties by the negligence of an independent contractor or that of the contractor’s employees.
