Favorable Settlement for Residents in Protracted Condominium Dispute
Represented six residents of the Biscayne 21 condominium in a dispute with Two Roads Development over the termination and demolition of the 61-year-old tower building on Biscayne Bay in Miami. The developer had already terminated the condominium and begun demolition efforts when the holdout residents hired Armstrong Teasdale to file suit, arguing the developer illegally lowered the required approval threshold for terminating the condo association. After Florida’s Third District Court of Appeal ruled in the residents’ favor, the Florida Supreme Court rejected the developer’s appeal in October 2025. On remand, the Miami-Dade Circuit Court declared the termination invalid and ordered the developer to restore the condominium and the residents’ units to their original condition. Following the Circuit Court order, the developer reached a settlement with the residents.
