Success for Pharmaceutical Client in High Court Case
An Armstrong Teasdale team led by Partner and U.K. Head of Commercial Litigation Robert Paydon secured a victory for client Unichem Laboratories Limited, a Mumbai-headquartered pharmaceutical company, in a Judgment handed down by the High Court in London on 23 June 2021 (Jamp Pharma Corporation v Unichem Laboratories Ltd [2021] EWHC 1712 (Comm) (23 June 2021) (bailii.org)).
The claimant, Jamp Pharma Corporation, alleged that it had reached a legally binding agreement with Unichem for the supply of Tizanidine, a muscle relaxant drug, for the Canadian market, while Unichem argued that there was no legally binding agreement in place because it was conditional upon the terms being set out in a formal addendum signed by both parties. The addendum had not been signed by both parties and the trial judge, Sir Ross Cranston, determined that there was no legally binding agreement in place. He therefore dismissed Jamp’s claim.
