Defense Verdict on Race, Retaliation, Whistleblowing Claims
Obtained a defense verdict for a public employer on claims of race discrimination and retaliation under the Missouri Human Rights Act and public employee whistleblowing. The plaintiff alleged he was not selected for promotion based on his race and had challenged leadership about the role of race in hiring decisions. He also alleged he was subjected to discipline and nonrenewal of his contract as retaliation. We showed at trial that the decisions related to the plaintiff were based on performance issues and not his race or alleged complaints. After a five-day trial, the jury found in the client’s favor on all theories of liability.
